Chairman Feeney called the meeting to order at 7:30 p.m. He noted the exits for the sake of the audience in the event they were needed.

CASE OF FALLATI – 6483 Vosburgh Road
Public hearing on the final plat on a two lot subdivision of 1.7 acres. Zoned R-20.

The case of the Paul Fallati will be heard on Wednesday, March 14, 2007, at 7:30 p.m. at the Guilderland Town Hall, Route 20, Guilderland, New York 12084 for the purpose of obtaining final plat approval for an unnamed subdivision.
Such subdivision is proposed as 2 lots cut from 1.7 acres.
The general location of the site is at 6483 Vosburgh Road
The property is zoned: R-20
Tax Map # 39.00-2-24
Plans are open for inspection, by appointment, at the Planning Department during normal
business hours.

Jan Weston, Town Planner, read the comments of the Planning Department as follows:
Fallati – 6483 Vosburgh Road
The applicant has submitted a final plat to create a one-acre keyhole lot behind an existing house on Vosburgh Road. As requested, he has included topography and the limits of grading and clearing. I have the following comments:
- It appears that the drainage currently flows into a federal wetland located on the proposed Twenty West subdivision. If any grading or filling is proposed, care should be taken to insure that water does not impact the adjacent neighbors.
- The access for the new lot will create a 3 ½ ft. setback to an existing shed.
The shed should be relocated or a variance from the 5 ft. setback requirement will be necessary.
The applicant has been informed of both the sewer hook up fee, the park fee, and the $1,500 Vosburgh Road improvement fee. No objection to final approval.

Paul Fallati presenting: Hershberg & Hershberg did a drawing to show the ¾ acre lot from the front and the 1.97 acre lot in the rear of the property and does meet all of the town standards. The proposed driveway has been shown. Also, I am looking at potentially relocating the existing U-Shape driveway to take it away from the driveway that is going to the rear lot.
Chairman stated: I notice that between the two properties there are a lot of large white pine trees. Is that between the driveway and the property to the east and will they remain?
Mr. Fallatie explained: It is fairly wooded and I could not tell you exactly where all the trees were located and I am not sure about what trees will be taken down.
Chairman asked for any comments from the Board.
Terry Coburn wanted to know what the applicant plans on doing with the shed.
Mr. Fallati explained: I will be removing the shed and dispose it.
Chairman asked for any comments from the audience.
Susan Batty, Vosburgh Rd. addressed her concerns. I was concerned about further development of the road due to the substandard nature of the road and that development has still continued. Concern about the three new driveways being close to one another and this raises concern for such issues as water and sewer and possibly gas hook up. I am concern about the cutting of the trees and the wetlands.
Will there be an environmental impact statement done?
Chairman said no. An environmental assessment form has been filled out by the applicant.
Chairman stated: For the record, I do have comments from the Guilderland Conservation Advisory Council, dated December 6, 2004, and summarizes as: GCAC does not see any adverse environmental effects of this proposed subdivision other than the addition of one more dwelling in an increasingly populated portion of the Town, so long as any drainage problems that may result from development are contained and managed within the area itself.
Chairman added: To note for the record: I was out there today doing some traffic counts during the peak morning hours. There were five vehicles entering and one vehicle going out in the twenty minutes that I was there. That did not seem to be that much traffic for a residential street.
Chairman made a motion to close the hearing and it was seconded by James Cohen and carried by a 7-0 vote by the Board.
Chairman made a motion for SEQR Determination as follows:
In Accordance with Section 8-0113, Article 8 of the New York Environmental Conservation Law, this Agency has conducted an initial review to determine whether the following project may have a significant effect on the environment and on the basis of the review hereby finds:
The proposed project will not have a significant effect on the environment and therefore does not require the preparation of an Environmental Impact Statement. This determination is based on a careful review by the Planning Board, and by the comments of the Guilderland Conservation Advisory Council, and by the environmental short form, which the applicant has filled out, and the minor nature of this proposed 2-lot subdivision (1 additional lot) with public sewer and water available.
The motion was seconded by Thomas Robert and carried by a 5-0 vote by the Board.
Chairman made a motion to approve the final plat for the proposed two lot subdivision on Vosburgh Road with the following conditions:
· Town Highway Superintendent approval for any new curbcut
· Town Water & Wastewater Superintendent approval
· $1,500.00 per dwelling unit – Park & Recreation Fund (with building permit applications)
· $2,085.00 per dwelling unit – sewer mitigation fee (with sewer hook-up application)
· $1,500.00 Vosburgh Road mitigation fee
· Remove easternmost driveway access to Vosburgh Road
· Show water and sewer connection locations
· Remove existing shed to eliminate need for a variance
The motion was seconded by Thomas Robert and carried by a 7-0 vote by the Board.
